contravention of the fourth amendment and complete contravention of the law at that time. as i'm sure and many of my colleagues will certainly recall this was revealed to the american public four years later when it was reported in "the new york times" in 2005. and in response after years of back and forth contentious debate, congress passed the fisa amendments act, the bill that we are considering on this floor today. we're considering a reauthorization. this law gave the government new surveillance authorities, but it also included a sunset provision to ensure that congress examines where the law is working and the way it was intended. now, the debate we're having right now on this floor is that reexamination. i will just note that i think it's unfortunate that we're doing this at the last second. we have known that this intelligence law is going to expire for years. it was laid out for a multiyear span. and certainly, it is irresponsible for this chamber to be debating this bill under a falsely created pressure that it needs to be done without any amendments in order to match the bill from

bad law taking effect which is increasing tax rates on everybody, huge increases on capital gains, massive increase on dividends. this is destructive. i see my mission in part to try to absolutely minimize the damage. unfortunately, i don't have the ability to repeal that law and the democrats control two out of the three parts of the elect ared government. i will fight as hard as i can to minimize this damage. but i got to be honest with you, i mean we got a pretty tough hand to deal with here. and we can't just change that law by ourselves. >> sean: it seems to me senator johnson three things that maybe the president hasn't thought of. number one if the president goes over the fiscal cliff on his watch the optics are not very good for him. while he may think there is an advantage here when the country sees its taxes go up then he comes in as the guy that is the tax cutter. has he tored in the republicans -- factored in the republicans have control of the budget with the debt ceiling? >> i think the president is beginning to see the long-term consequences if we do increase taxes.

the mexican government using our court system to fight arizona's sb1070 immigration law. it wants a u.s. circuit court of appeals to block part the of the law that makes it illegal to protect illegal immigrants. mexicans say it's anti-immigration and antimexico. jamie weinstein says it's anti-illegal immigration. you listen to this and -- break it down. so mexico wants the arizona courts to say it's illegal to ban harboring illegal mexicans. do i have that right? >> actually, the -- in arizona court, a lower court put this law on hold. it's before the u.s. court much appeals in san francisco where the mexican government filed an amicus brief saying the law, it's illegal to harbor illegal immigrants but only if you're committing a crime or in the process of committing a crime in addition to that. that's the only people in violation. if you're already committing a crime or having committed a crime and harboring illegal immigrants. the brief says the law, one, harms diplomatic relation with g united states and prevents the mexican government from negotiating with the united states becaus

in advance what the tax laws are and rates will be. we cannot long tolerate a government that puts together scotch tape deals in the last minute and literally the last minute so two days ago people didn't know the taxes rates today. that's from a neutral point of view. from a partisan point of view if you permit me, it's a total -- the republicans didn't gain anything from the deal giving the president everything he wanted. they don't stand for any small government, lower taxes, stop the borrowing values. they have opportunities to redeem themselves, like, with the debt ceiling, but they're behavior -- charles: judge, i think what republicans say, is we lost the public relations battle. maybe the country has to see what the end results of what these policies are. we can't warn because they don't believe us. live through it, maybe it takes a couple years of the free willing spending, $20 trillion in debt to somehow trigger a grand epiphany. that could be the only way. %-program, we played greek musi, tongue-in-cheek, but kind of serious. cue the music. by the way, it is the song played on a

in a couple of days, the losses of every american's paycheck will get a lot smaller. -- the law assays that every american's paycheck will get a little smaller. but congress can prevent it from happening, if they act now. we may be able to reach an agreement that can pass both houses in time. but if an agreement is not reached on time, then i will urge the senate to hold an upward bound to vote on a basic package that protects the middle class from an income tax hike, extends vital unemployment insurance for americans looking for a job, and lays the groundwork for future progress. such a proposal could pass both houses with bipartisan majorities, as long as these leaders allow to come to a vote. if they still want to vote no, that is their prerogative. but they should let everybody else vote as well. that is the way this is supposed to work. we cannot afford a politically self-inflicted wound to our economy. the economy is growing. the folks you sent to washington have to do their jobs. the housing market is healing, but that could stall if folks are seeing smaller paychecks. unemploym
